These terms cover your use of the Restwell iPhone app. By using it, you agree to them.

Restwell is not a medical device and does not diagnose anything. It is a consumer app that estimates sleep from a phone's microphone and motion sensor. Those estimates are not clinical measurements, and nothing it shows you — including anything about snoring or pauses in breathing — is a diagnosis or medical advice.

Only a sleep study, ordered and read by a clinician, can tell you whether something about your sleep needs attention. If you are worried about your sleep or your breathing, talk to a doctor. Do not use Restwell to diagnose, treat or rule out any condition, and do not delay seeking medical advice because of something this app showed you.

What Restwell can and cannot measure

Restwell is deliberate about the limits of what a phone can observe, and you should be too:

Subscriptions and payment

Restwell offers auto-renewing subscriptions. Prices are shown in the app in your local currency before you buy.

All billing is handled by Apple. Refunds are at Apple's discretion and are requested through Apple, not through us.

Your content and your data

Your sleep data and recordings stay on your phone. We do not receive, store or have any access to them — see the Privacy Policy. Because of that, we cannot recover your data if you lose your phone, delete the app, or restore a device without a backup. Restwell's export feature exists so you can keep your own copy.

Availability and changes

We may update, change or discontinue Restwell or any of its features. Apps depend on operating systems that change without our involvement, and we cannot guarantee the app will work forever or on every future version of iOS. If the app is discontinued, active subscriptions will not be renewed further.

No warranty

Restwell is provided "as is", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy. We do not warrant that the app will be uninterrupted, error-free, or that its sleep estimates will be accurate.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of Restwell. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the twelve months before the claim.

Some jurisdictions do not allow certain limitations, so parts of the two sections above may not apply to you.

Apple

Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for Restwell. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of [STATE], United States, without regard to conflict of law rules.
