Terms of Use

These terms cover your use of the Restwell iPhone app. By using it, you agree to them.

What Restwell can and cannot measure

Restwell is deliberate about the limits of what a phone can observe, and you should be too:

• It does not measure REM sleep from phone sensors, because a phone cannot observe eye movement or brain activity. REM is only ever shown when an Apple Watch recorded it.
• Sleep and wake are estimated from movement and sound, not measured directly. Accuracy depends heavily on where the phone is, how noisy the room is, and whether you share a bed.
• When a night cannot be measured reliably, Restwell says so rather than presenting a confident number. Please take that seriously when it appears.

Subscriptions and payment

Restwell offers auto-renewing subscriptions. Prices are shown in the app in your local currency before you buy.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours of the end of the current period.
• You can manage or cancel a subscription at any time in your Apple ID account settings.
• Where a free trial is offered, any unused portion is forfeited if you buy a subscription during the trial.

All billing is handled by Apple. Refunds are at Apple's discretion and are requested through Apple, not through us.

Your content and your data

Your sleep data and recordings stay on your phone. We do not receive, store or have any access to them — see the Privacy Policy. Because of that, we cannot recover your data if you lose your phone, delete the app, or restore a device without a backup. Restwell's export feature exists so you can keep your own copy.

Acceptable use

You agree not to:

• Use Restwell to record anyone without their knowledge, or in any way that breaks the law where you are. Recording laws differ by country and by state, and complying with them is your responsibility.
• Reverse engineer, decompile or attempt to extract the app's source code, except where that right cannot lawfully be restricted.
• Resell, redistribute or sublicense the app.

Availability and changes

We may update, change or discontinue Restwell or any of its features. Apps depend on operating systems that change without our involvement, and we cannot guarantee the app will work forever or on every future version of iOS. If the app is discontinued, active subscriptions will not be renewed further.

No warranty

Restwell is provided "as is", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or accuracy. We do not warrant that the app will be uninterrupted, error-free, or that its sleep estimates will be accurate.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from your use of Restwell. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the twelve months before the claim.

Some jurisdictions do not allow certain limitations, so parts of the two sections above may not apply to you.

Apple

Apple is not a party to these terms and has no responsibility for the app. Apple has no obligation to provide support for Restwell. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of [STATE], United States, without regard to conflict of law rules.
